Exploring women's rights under the law

The Director of Institute Islam Hadhari and Professor of Law in Family, Women and Children at Universiti Kebangsaan Malaysia (UKM) Prof Dato’ Noor Aziah Mohd Awal was invited to give a talk titled “Women’s Rights under The Law”. The talk was held on 15 August 2019 at UTAR Sungai Long Campus. It was organised by the Centre for Sustainable Development and Corporate Social Responsibility in Business (CSDCSR), and Faculty of Accountancy and Management (FAM).

Before Prof Dato’ Noor began her talk, she introduced the applied law and common law systems in Malaysia. She then shared issues related to women and children in Malaysia. “Women must be given full respect from a man’s perspective and freedom for themselves,” said Prof Dato’ Noor. She also explained the differences between Muslim and non-muslim laws that women can apply.

According to Prof Dato’ Noor, the fundamental liberties in Malaysia are made by the federal constitution. It is the part II of the Federal Constitution, from Article 5 to 13 which include liberty of the person, prohibition on slavery and forced labour, protection against retrospective criminal laws and repeated trials, equality, prohibition of banishment and freedom of movement, freedom of speech, assembly and association, freedom of religion, right to education, and right to property. She also said that women can protect themselves against violence by Penal Code and Domestic Violence Act 1994.

She further elaborated on child marriage (under 18 years old) and gave examples of cases that took place in Malaysia. Later, she explained “Outrage of Modesty” in Section 354— whoever assaults or uses any criminal force on any person with the intention to outrage modesty and Section 509— whoever intends to insult the modesty of any person by uttering words, making any sound or gesture or disturbing the privacy of that person. She also gave a few examples of outrage modesty to provide participants a better understanding.

“Women must always seek knowledge in relation to their rights. They must not allow themselves to be bullied at home or at work. Women empowerment is important and we need everyone to contribute and cooperate towards these goals,” said Prof Dato Noor.
